Terms of Service

Version 2026-10-17 · Effective October 17, 2026

The website at https://myphone.host and the MyPhone number, call answering, voicemail, warm transfer, SMS, wallet, and Grok Bot connection (together, the "Service" or "Site") are operated by MyPhone ("MyPhone," "Company," "we," "us," or "our"). Additional guidelines posted on the Service are part of these Terms.

These Terms of Service ("Terms") govern your use of the Service. By accessing or using the Service, or by telling Grok Bot that you agree, you agree to these Terms and the Privacy Policy for yourself, and you confirm you have authority to do so. You must be at least 18 years old. If you do not agree, do not use the Service.

Please read Section 13 carefully. It is an agreement to resolve disputes through binding individual arbitration instead of in court, and it includes a waiver of class actions and jury trial. You have 30 days to opt out, as described in Section 13.

1. Accounts

Creating an account. Grok Bot creates the account when you give your name and email and agree to these Terms and the Privacy Policy. You agree to provide accurate information and keep it current. You can ask us to delete your account by emailing [email protected]. We may suspend or terminate an account as described in Section 10.

Account security. You connect Grok Bot by signing in at myphone.host/connect and allowing access. You are responsible for your sign-in and for activity by any bot you allow. Tell us right away if you think someone else used your account. We are not liable for losses from your failure to keep it secure.

2. Access to the Service

License. Subject to these Terms and your payment, we grant you a limited, non-exclusive, non-transferable, revocable license to use MyPhone so your Grok Bot has a phone number.

Restrictions. You may not: (i) license, sell, rent, lease, transfer, assign, or otherwise commercially exploit the Service except as we expressly allow; (ii) modify, create derivative works from, disassemble, reverse-compile, or reverse-engineer any part of the Service; (iii) access the Service in order to build a similar or competing product; (iv) copy, republish, or transmit the Service except as these Terms allow; (v) use the Service to violate law or anyone else's rights; (vi) send spam or unsolicited communications; (vii) probe, scan, or test the vulnerability of the Service without our written permission; or (viii) upload malware or content that infringes third-party rights. Keep proprietary notices intact on any copies you are allowed to make.

Changes. We may modify, suspend, or discontinue the Service (or any part of it) at any time. We are not liable to you for that.

Support. Email [email protected]. We have no other obligation to provide support.

Ownership. Intellectual property in the Service belongs to MyPhone or its suppliers. These Terms do not transfer ownership to you. All rights not granted are reserved. The phone number is reserved for your account and looked after by MyPhone. It is not a promise that a carrier will never reclaim a number under its own rules.

Feedback. If you send us ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without attribution. Do not send feedback you consider confidential.

3. Your content, calls, and SMS

You keep ownership of the instructions, greetings, and other content you submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process Your Content, calls, recordings, transcripts, and SMS as needed to operate and provide the Service.

Grok Bot may answer the call, forward it to the phone you saved, take a voicemail, or do a warm transfer. Calls, recordings, and transcripts are stored. You can access and export them through your Grok Bot MCP connection, including to other tools you have connected.

Call recording consent. Calls and voicemails may be recorded. By using the Service you consent to that recording and storage. You are responsible for giving callers any notice the law requires before or during a recorded call.

SMS consent. Texting is part of the Service. You opt in when you agree to these Terms and ask Grok Bot to send or receive SMS on your MyPhone number. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Carrier rules for A2P 10DLC and the CTIA Messaging Principles and Best Practices apply to application-to-person texts. You will not use the number to send spam or messages people did not agree to receive.

Mobile numbers and opt-in data are not shared or sold to third parties or affiliates for marketing or promotional purposes.

You are responsible for Your Content and for how Grok Bot uses your number. You represent that you have the rights needed to use that information in the Service.

4. Fees and billing

Pay as you go is the default. Checkout happens in Grok Bot. We do not ask for your card number in chat, and we do not send an invoice.

  • Each number is $5 a month, charged to the card you save.
  • You save that card through the one-time link Grok Bot sends before a number is purchased. Square stores the card.
  • Your wallet starts with $20.
  • When the balance is $5 or less, we automatically add $20 to the saved card. That stays on unless you turn it off.
  • You can add other top-ups from the saved card. The usual top-up is $20.
  • Minutes and texts come out of the wallet at the prices Grok Bot reads from get_pricing. Do not rely on a price quoted from memory.
  • Monthly plans (MyPhone Line, MyPhone Voice, MyPhone Desk) are optional. They are offered only when a month of pay-as-you-go spend is over that plan's price.

Fees are shown in Grok Bot before a charge. Unless we say otherwise, fees are non-refundable. You authorize us and Square to charge the card on file for the number fee, wallet top-ups, automatic $20 refills, and any monthly plan you accept.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which is part of these Terms. If there is a conflict about how we collect or use personal information, the Privacy Policy controls.

These Terms are version 2026-10-17, effective October 17, 2026. The Privacy Policy is version 2026-10-17. Before a number is purchased or a card is saved, you must agree to the current versions. We keep a record of that agreement.

6. Indemnification

You agree to defend, indemnify, and hold harmless MyPhone and its officers, employees, and agents from claims and reasonable costs (including attorneys' fees) arising out of (i) your use of the Service, (ii) Your Content, calls, or texts on your number, (iii) your violation of these Terms, or (iv) your violation of law, including rules about consent to call, record, or text. We may take over the defense at your expense, and you will cooperate. You will not settle a claim that names us without our prior written consent.

7. Third-party services and other users

Third-party services. The Service relies on Twilio for calls and SMS, Square for cards, xAI for Grok, and the Grok Bot app you already use. We do not control them. Their terms and privacy policies apply. We are not responsible for their availability or practices.

Other people. Calls and texts with other people are between you and them. We are not responsible for those conversations, and we may (but need not) step into a dispute.

Release. To the fullest extent permitted by law, you release MyPhone and its officers, employees, agents, and successors from claims arising out of the Service, callers, or third-party services. If you are a California resident, you waive California Civil Code Section 1542, which says a general release does not extend to claims you do not know about at the time of the release.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, MYPHONE AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, A CALL, A TEXT, A TRANSCRIPT, OR GROK BOT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL CODE. WHERE LAW REQUIRES WARRANTIES, THEY ARE LIMITED TO 90 DAYS FROM YOUR FIRST USE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) MYPHONE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR LOST PROFITS, LOST DATA, SUBSTITUTE COSTS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM IS CAPPED AT THE GREATER OF (i) USD $100 AND (ii) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. MULTIPLE CLAIMS DO NOT RAISE THIS CAP.

10. Term and termination

These Terms apply while you use the Service. You may stop at any time. We may suspend or terminate access (including releasing a number and deleting an account) if you violate these Terms, if we have to for legal or security reasons, or if continuing is not commercially viable. We are not liable to you for termination. Upon termination your right to use the Service ends. Sections 2 (restrictions, ownership, feedback), 3, and 5 through 13 survive.

11. State-specific legal notices

These notices apply only to the extent you are protected by that state's laws. If they conflict with another section, the state notice controls for those users.

California. You may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 N. Market Blvd. Suite N112, Sacramento, CA 95834, or (800) 952-5210. Under California Civil Code Section 1789.3: the provider of the Service is MyPhone, reachable at [email protected]. To file a complaint or request more information, email that address or write the Consumer Affairs unit above. California residents may also have CCPA/CPRA rights (know, delete, correct, opt out of sale/sharing). See the Privacy Policy.

Colorado, Connecticut, Virginia, Texas, and other comprehensive state privacy laws. You may have access, correction, deletion, portability, and opt-out rights. See the Privacy Policy.

Nevada. You may direct us not to sell certain information. We do not sell covered information. Email [email protected] to make a request.

12. General

Changes. We may update these Terms. The version and effective date on this page will change. If we make material changes, we may email the address on your account or post a notice on the Service. Continued use after notice means you accept the updated Terms. Buying a number or saving a card still requires a recorded yes to the current version.

Governing law. These Terms and any dispute related to them or the Service are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules. For any claim not subject to arbitration in Section 13, you and MyPhone consent to the exclusive jurisdiction of the state and federal courts located in Louisiana. Either party may still seek injunctive relief in any competent court to protect intellectual property, and either party may bring an individual action in small claims court for claims that court can hear.

Export. You will not export or transfer anything from the Service in violation of U.S. export laws.

Electronic communications. You consent to receive notices from us by email, by SMS where you have opted in, or by posting on the Service. Those notices satisfy any legal requirement for written notice. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of SMS. Reply HELP for help.

Accessibility. We aim to make the Service usable, including for people with disabilities, and we work toward WCAG 2.1 Level AA. If you have trouble using the Service, email [email protected].

Entire agreement. These Terms, the Privacy Policy, and the prices shown by get_pricing are the entire agreement about the Service. If a provision is invalid, it will be modified just enough to be valid; the rest stays in effect. Our failure to enforce a provision is not a waiver. "Including" means "including without limitation." You may not assign these Terms without our consent; we may assign them. They bind permitted assignees.

13. Dispute resolution

Please read this section carefully. It affects your legal rights, including your right to sue in court and your right to a jury trial.

Applicability. Except as described below, you and MyPhone agree to resolve all disputes arising out of or relating to the Service or these Terms through binding individual arbitration — not in court. Exceptions: (i) claims that qualify for small claims court, brought individually; and (ii) requests for equitable relief related to intellectual property. This agreement covers claims that arose before you agreed to these Terms.

Try to resolve first. Before starting arbitration, send a written informal notice to [email protected]. Within 45 days, the parties will meet by phone or video in good faith. If that does not resolve it within 60 days of the notice, either party may start arbitration.

Arbitration rules. Arbitration will be administered by JAMS (www.jamsadr.com). Claims under $250,000 (excluding fees and interest) use JAMS Streamlined Arbitration Rules; larger claims use JAMS Comprehensive Arbitration Rules. Unless we agree otherwise, arbitration takes place in the county where you live. Arbitration materials are confidential.

A demand must include: (i) your contact information and account email; (ii) a description of the claims and facts; (iii) the relief sought and a good-faith damages estimate; (iv) confirmation that you completed informal resolution; and (v) proof of any required filing fee.

Authority of arbitrator. The arbitrator may resolve arbitrable disputes, including scope and enforceability of this agreement — except that courts decide: (i) challenges to the class-action waiver; (ii) disputes about arbitration fees; (iii) whether a condition precedent was met; and (iv) which version of this agreement applies. The arbitrator may award the same relief as a court, but only on an individual basis. The award is final and binding.

Waiver of jury trial. BY AGREEING TO ARBITRATION, YOU AND MYPHONE WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY FOR COVERED CLAIMS.

Waiver of class actions. ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY. NEITHER YOU NOR MYPHONE MAY BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. If a court finds this waiver unenforceable as to a specific claim, that claim may be litigated in state or federal court in Louisiana; all other claims stay in arbitration.

Attorneys' fees. Each party bears its own attorneys' fees unless the arbitrator finds a claim was frivolous or brought for an improper purpose.

Batch arbitration. If 100 or more substantially similar demands are filed against MyPhone within 30 days by the same firm or coordinated group, JAMS will batch them into groups of 100 with one arbitrator and one fee set per batch.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name, address, and a clear statement that you opt out. Opting out does not change the rest of these Terms.

Severability. If part of this arbitration agreement is invalid, it will be modified just enough to be enforceable; the rest remains in effect.

A number for your Grok Bot.
